I provide a full range of professional services to employees:

 

  • I review the sufficiency and fairness of proposed severance agreements at termination. I advise whether to reject the proposed severvance, and I will negotiate a more favorable severance in view of the legal issues identified for release and waiver. 

 

  • I counsel employees pre-litigation to determine the legal basis of possible action against their employer for wrongful termination against their employer.  I provide a dispassionate, objective assessment of the strengths and weaknesses of a potential case, and I recommend litigation only in those cases having substantial merit.   
  • I design a strategy of the case based on the facts and likely best explanation for why events occurred as they did leading to a job loss. 

  • I listen carefully to how the job loss has affected you, and try to understand why this case is important to you personally.  I try to tell YOUR story.

  • After overviewing the strengths, weaknesses, opportunities, and risks of the case, I listen to your objectives and goals, and I share with you the practical realities of what can be obtained.  I do not exaggerate or understate the value of your case.  Good cases justify full commitment of both attorney and client. 

  • I continuously involve you in the progress of the case, and continuously provide updated re-evaluations of the value of the case as it progresses through litigation/negotiation.

 

  • I explain the process, and prepare you for it.  I do my best to avoid surprises, and reduce your stress so that your presentation is the best possible.

 

  • I stay current in employment law developments, and especially cases that bear on your particular case.  I explain the law to you without technical jargon, or unneeded detail.

 

  • I review employment agreements, and will assist in drafting employment agreements.

 

  • I advise employees about restrictions on future employment stated by confidentiality and trade secret agreements.  I will defend employees who are threatened by injunctive actions by their former employers for alleged breach of trade secret obligations. 

 

  • I will counsel employees on best responses to proposed employer disciplinary action.

 

  • I will evaluate your case for settlement at various stages, make recommendations, and negotate your case to resolution.

 

  • If the case merits, I will try your case through trial and appeal.
